haynsw.com.au is a product of the CLIP™ concept.

CLIP™ is a concept and pending registered trademark of Anna Jane Anderson ABN 70 981 300 236.

CLIP™ stands for Comprehensive Local Information Point, a community centric website that offers a comprehensive searchable Directory of businesses and organisations in a district along with a Billboard as a conduit for introducing items for sale, items wanted, freebies and events for that same district. haynsw.com.au is a product of the CLIP™ concept.

CLIP™, its concept or any part of it can not be used without permission of Anna Jane Anderson, PO Box 399, Hay, NSW 2711, 02 6993 2002, clip@clip.net.au.

haynsw.com.au website is operated by Anna Anderson (ABN 70 981 300 236) and is also known as “us" or "we" throughout these Terms and Conditions. haynsw.com.au’s Billboard Listing and its method of searching and Directory Listing including Listing Ad-ons are a part of the CLIP™ concept which is owned by Anna Anderson.

The haynsw.com.au Billboard is an online advertising medium and marketplace that advertises items for sale, via traditional "Contact Me" advertising (where potential buyers can browse listings and then purchase items by contacting sellers and negotiating the sale privately).

The haynsw.com.au Directory is an online search engine and advertising medium for businesses and organisations both private and government. Every endeavour is undertaken to include all businesses and organisations in the Hay, Booligal, Booroorban, Carrathool, Gunbar, Maude, One Tree and Oxley area of New South Wales in the Directory. Each business or organisation in the Hay, Booligal, Booroorban, Carrathool, Gunbar, Maude, One Tree and Oxley area is permitted to include their business/organisation name, address, contact name, phone number, mobile phone number, fax number, type, up to twenty descriptors (used by the search engine) and UHF Channel for no cost. Inclusions of website hyperlinks &/or a additional mobile or phone numbers, photos, logos, open hours, a description of the business or organization and ABN (hereon in called Listing Ad-ons) will incur a charge as set out in List of Fees.

We recommend that you carefully read these Terms & Conditions before you use the haynsw.com.au site.

These Terms and Conditions apply to all users of the haynsw.com.au site.

However, there are specific clauses that apply only to either the Billboard or Directory. You must read all of these Terms and Conditions carefully to understand the specific terms and conditions that apply to the service you are provided. If you do not agree to these Terms and Conditions, you should not use the haynsw.com.au site or the relevant service.

From time to time, we may need to change these Terms and Conditions to reflect our changing business. We may also need to change these Terms and Conditions if we are required by law, for security reasons or for technical or infrastructure reasons.
We are not involved in the actual transaction between sellers and buyers, or provider. We are merely a passive conduit for the on-line distribution and publication of information about items advertised for sale, items wanted, freebies, requests for donation or events. As a result, we have no control over and, to the extent permitted by law, make no warranties in relation to, the suitability, quality, safety or legality of any items advertised for sale or offer, the accuracy or truth of any listings on the haynsw.com.au site or the ability of sellers and buyers to actually enforce or complete a transaction.

Copyright of the content on the haynsw.com.au site and in the haynsw.com.au site itself (as a compilation of information) is owned by Anna Jane Anderson, our advertisers or content suppliers.

You as a user;

warrant that any Items you submit for inclusion in the haynsw.com.au site are factually correct and comply with these Terms and the Guidelines.

must comply with these Terms when accessing and using the haynsw.com.au site.

warrant to us that you will not use the haynsw.com.au site for any purpose that is unlawful or prohibited by these Terms.

The haynsw.com.au site and the material contained on it are supplied solely for reference purposes.

You may download and print individual business/organisation listings from the haynsw.com.au site for your own private, non-commercial use. Apart from this, you must not use, reproduce, communicate, publish, or distribute any of the content on the haynsw.com.au site, unless this constitutes a fair dealing for the purposes of the Copyright Act 1968 (Cth) unless agreed to in writing.
In particular you must;

not reproduce or use any of the listings on the haynsw.com.au site for commercial purposes or for commercial gain.

not data mine or conduct automated searches on the haynsw.com.au site or the content on the haynsw.com.au site, whether through the use of additional software or otherwise;

not incorporate any of the content on the haynsw.com.au site with any other material, including advertising or promotional material;

not create HTTP links from the haynsw.com.au site to any other website on the Internet, or frame or mirror the haynsw.com.au site without our prior written consent;

not use the haynsw.com.au site or any facilities available on the haynsw.com.au site for any activities, or transmit to or via the haynsw.com.au site any information or material, which:

breach any laws or regulations;
breach these Terms and conditions;
infringe a third party's rights (including intellectual property rights, rights of privacy or their trade secrets);
is inappropriate, offensive, obscene, threatening, indecent, inflammatory, pornographic, defamatory or confidential;
is false or misleading;
is discriminatory in breach of State or Commonwealth anti-discrimination legislation; or
identify a person or which can be used to identify a person (including any copy, photos or other pictorial representations) unless you have obtained that person's authority;

not use the haynsw.com.au site or any facilities available on the haynsw.com.au site to defame, harass, threaten, menace or offend any person;

not tamper with, hinder the operation of, or make unauthorised modifications to the haynsw.com.au site or any content on the haynsw.com.au site;

not knowingly transmit any virus, worm, Trojan horse or other disabling feature to or via the haynsw.com.au site;

not use the haynsw.com.au site to send commercial, unsolicited or bulk electronic messages to anyone or in any other way which would constitute an infringement of the Spam Act 2003 (Cth); or

not attempt to do, or permit another person to do, any of the above acts.

We may withdraw or alter any material you provide us if:

we reasonably consider it is inappropriate, offensive, misleading or deceptive, defamatory, incorrect or in any other way in breach of these Terms and Conditions, any law or third party rights; or

we are instructed to do so by any third party.
We will tell you if we do this
 
You must be at least 18 years of age to place a Billboard Listing or a Directory Listing Ad-on with us.

If you are a seller you must be legally able to sell the item you are advertising.

To lodge a request on behalf of a charity, community group or not-for-profit organisation you must have permission from such to do so.

We reserve the right (but are not required) to verify the availability of items offered for sale, and to verify the information contained in any Billboard listings. You agree that we may access your records and systems and/or contact you for the purposes of verification or clarification. You agree to provide such additional information as we reasonably require.

The haynsw.com.au site may contain links to other websites which are not maintained or controlled by us or our related companies ("third party site"). Third party sites are not part of the haynsw.com.au site. These links are provided by us solely for your convenience. We make no representations or warranties whatsoever about any third party site. We do not endorse, and accept no responsibility for, the content or use of any third party site. If you link to any third party site, you leave the haynsw.com.au site and do so entirely at your own risk.

We do not represent or warrant that the content on the haynsw.com.au site complies with the laws of any country outside of Australia. If you access the haynsw.com.au site from outside Australia, you do so at your own risk.

Nothing on the haynsw.com.au site constitutes an offer to provide goods or services in any jurisdiction if to do so would contravene the laws of that jurisdiction.

We take all reasonable care in compiling the online Billboard Listing and Directory Listing. However, the information on the haynsw.com.au site is provided 'as is' and we do not warrant or represent that it is complete, current or free from errors or omissions.

We provide our services with reasonable care and skill and endeavour to ensure availability of our services and access to the haynsw.com.au site. However, availability of our services and access to the haynsw.com.au site may be interfered with by numerous factors, including those outside our control (such as malfunction in equipment or software, Internet access difficulties, or delay or failure of transmission). Accordingly, we do not warrant or represent that our services and/or your access to the haynsw.com.au site will be continuous, uninterrupted, timely, fault free, virus free or secure.

We accept ads in good faith on the basis of warranties provided by each advertiser. We do not warrant or represent that the products or services advertised in ads on the haynsw.com.au site will be suitable for any particular purpose, or that an advertiser or an organisation requesting donations has any particular qualifications or is legally entitled to carry on a particular business. You must investigate for yourself the suitability, quality and condition of any goods or services advertised on the haynsw.com.au site and it is your responsibility to verify any information on the haynsw.com.au site.

The terms that apply to our supply of the haynsw.com.au site are those that are set out in this document and those implied by consumer protection laws to the supply of this service that are unable to be excluded. No other terms apply.

We may suspend, terminate or limit your access to the haynsw.com.au site at any time if:
you are in material breach of these Terms and conditions; and
we have told you in writing of your breach and you have failed to remedy it within 14 days of us telling you; or
the breach is something which cannot be remedied (in which case we can cancel the service immediately by telling you).

We may suspend, terminate or limit your access to the haynsw.com.au site with as much warning as we reasonably can, if:

we reasonably believe that there is a real risk of loss or damage to us or another if
we do not suspend, terminate or limit your access to the haynsw.com.au site (including credit risk resulting from you not paying any fees owed to us on time);
the law requires us to do so;

we believe on reasonable grounds that providing access to the haynsw.com.au site to you is illegal or may become
illegal; or
there is an emergency.

We and you are independent contractors and no agency, partnership, joint venture or employment relationship is intended or created by these Terms.

If any of these Terms are invalid, unenforceable or illegal, that term will be struck out and the remaining terms will remain in force.

Your Directory listing may only include text descriptions, graphics, pictures and other content relevant to that item. In addition, any phone number or logo provided by you for listing in an ad must be yours, or you must have permission to use it. You must ensure that any phone number listed is correct.

We reserve the right to modify or refuse any ad.

You hereby assign all copyright in your Billboard listing and/or Directory listing to us.

Where GST is applicable on any items you advertise the advertised price must be inclusive of GST.

Only Directory Listing Ad-ons fully completed and paid for will be displayed on the haynsw.com.au site. Please submit your Directory Listing Ad-ons early to avoid congestion, frustration and disappointment closer to the deadline.

We make no guarantees or representations regarding placement of your listing. We also reserve the right to select, edit, condense, determine the duration of, change the nominated "Category/type" of, withdraw or refuse a Billboard or Directory Listing.

We do not accept or publish any Billboard or Directory listing containing any items which are prohibited for sale in any part of Australia.

Foul or inappropriate language is prohibited.

We will refuse to publish Billboard listings or Directory listings that we reasonably deem to be offensive or inappropriate for publication or any of the specified items listed below;

• Pornographic material that is:
  • X-rated
  • XXX-rated
  • Unclassified, or
  • RC (refused classification)
• Adult services
• Drugs & drug paraphernalia
• Alcohol & tobacco
• Food & food stuffs
• Pharmaceuticals & prescribed medications
• Weapons including:
  • firearms
  • crossbows
  • knives
  • swords
  • Ammunition and associated equipment
  • Explosives & fireworks
• Hazardous materials – chemical, biological, radioactive
• Human body parts or remains
• Stuffed animals or animal products, including eggs and ivory
• Radar detectors, radio scanners, jamming devices and prohibited speed measuring or traffic offence articles
• Surveillance equipment
• Satellite or cable TV descramblers
• Magnetic stripe or smart card programming devices
• Items referring to Nazis, the SS, or the KKK
• Items referring to being authentic German or Japanese WWII goods
• Government licenses, birth certificates, drivers licenses or passports
• Fake identification cards
• Law enforcement or security worker uniforms
• Emergency services worker uniforms
• Transport worker uniforms:
  • pilot
  • steward/stewardess
  • baggage handler
• Airport services
• Mass transit – train/bus/tram or related uniforms
• Medical equipment
• Gaming machines, eg. poker, slot, roulette
• Airline tickets and other transport tickets
• Boat Moorings
• Recalled products (www.recalls.gov.au)
• Raffles
• Vehicle compliance plates.
• Items that relate to crime, violence or hatred
• Items related to an act of crime, including photographs
• Items that are religiously or racially offensive
• Items that infringe third party intellectual property rights
• You must not promote or advertise goods and services that may infringe third party intellectual property rights. These goods or services include pirated, counterfeit or unauthorized:
  • Music
  • Movies
  • Television shows
  • Software
  • Video games
  • Currency, stamps, securities & equipment
  • Clothing, footwear and headgear
  • Boot leg audio or video
• Copyright circumvention devices, including mod chips for game consoles. This includes using business names or company names which may be construed as offering or promoting goods or services associated with mod chips or pirated/counterfeit software.
• Event tickets

While not prohibited by haynsw.com.au, the re-sale of event tickets (eg: tickets to concerts, theatre events, sporting events) is often controlled by the ticket issuer or promoter of the event. haynsw.com.au recommends that the re-seller of the ticket should contact the issuer before listing the ticket for sale on haynsw.com.au to ensure that re-sale is permitted. It is the ticket re-seller’s responsibility to ensure that the sale of the ticket does not contravene the terms and conditions of ticketing for the relevant event or any applicable law.

You agree that we have an unfettered right to use (in any way we see fit) any copyright subsisting in your Billboard listing or Directory listing. In this regard, it is your responsibility to procure any necessary moral rights consents from authors of work you submit as part of your Billboard listing or Directory listing.

You may cancel or withdraw your Billboard listing or Directory listing Ad-on at any time. Any cancellation of listing that were prepaid will be refunded (less any reasonable costs that we have incurred in relation to the ad) if cancelled prior to inclusion in the website. If you do not cancel or withdraw your listing before the inclusion on the website, you must pay for the Billboard listing or Directory listing Ad-on/s in full.

Selling or buying via the Billboard is available to both private and commercial advertisers. Commercial advertisers must include their business name.

All additions to the Billboard and Directory must be sent via email, post or facsimile and must include, in addition to any other material, a contact name and address and phone number and in the case of emails must include an email address.

It is your responsibility to notify us upon the sale or disposal of your Billboard item to ensure that the Billboard listing is removed from this haynsw.com.au site.

It is your responsibility to notify us of any changes that have occurred that are included in your Billboard listing or Directory listing including but not limited to any prices. All listings will be included on the website only after being vetted by the website administrator. All decisions about the content of the haynsw.com.au site are at the discretion of the website administrator and no discussion will be entered into.

You must state the full selling price of any Billboard listing Items in the appropriate sections made available for this purpose in the Billboard listing form. A Billboard listing must not state an alternative selling price in the item description.

In the event you are selling multiple items in a single Billboard listing, you must state the full combined selling price of all items as the selling price, with the exception of animal litters, where the individual cost of one animal may be specified.

Any fees you pay to place a Directory Listing Ad-on do not grant you exclusive rights to any web pages on the haynsw.com.au site. We may, without your consent or any payment to you, place third party ads or hyperlinks on any web page within the haynsw.com.au site.

You are responsible for paying all fees and taxes (including GST) associated with placing a Billboard listing or Directory Listing Ad-on on the haynsw.com.au site.

Unless otherwise provided, all fees listed on this haynsw.com.au site are inclusive of GST.

All Directory Listing Ad-ons must be prepaid.

All Directory Listing Ad-ons will be posted on the site for a 12 month period or a term determined at the discretion of the haynsw.com.au site administrator. A renewal fee will be charged after 12 months and the Directory Listing Ad-ons will be withdrawn from display if the fees have not be been paid prior to those Directory Listing Ad-ons expiry date.

Billboard Listings must include a description, a price if the item is for sale, a contact name, phone number, address and in the case of emails an email address.

Billboard Listings are limited to ten per customer unless agreed t o in writing by us..

Billboard Listings and Directory Listing Ad-ons that do not comply with these conditions will not be displayed.

Facsimiled/mailed Billboard listings and Directory listings must be typed or printed clearly.

Mistakes due to illegible writing will be your responsibility.

We will place items under the applicable "Category/type".

All Billboard listing items and Directory Listing Ad-ons will be published on the haynsw.com.au site where possible, within seven days following receipt of all relevant information.

We will cease a Directory Listing Ad-on if the advertiser does not honour their obligation to pay a renewal fee (unless the seller and buyer mutually agree to allow further time for payment).

Delivery of Billboard listing items is a matter to be arranged between the provider and requesting organisation. We take no responsibility for the delivery of items exchanged through the haynsw.com.au site.

Billboard items are listed free of charge unless specified in the list of fees.

Billboard items will be removed from the haynsw.com.au site 40 days after the date of their initial posting on the internet or at a date determined by us.

You are responsible for paying all fees and taxes (including GST) associated with placing Directory Listing Ad-ons.

haynsw.com.au is in the business of connecting buyers and sellers through classified advertising via  the Internet known herein as ‘Billboard’.

haynsw.com.au will endeavour to protect the privacy of all the individuals we deal with.
We recommend that you keep this information for future reference and read our Privacy Policy.
